Another ICA filed against decision in One Constitution Avenue Case

Another Intra-Court Appeal (ICA) has been filed before the Islamabad High Court (IHC) challenging the single bench decision of April 30, in the One Constitution Avenue case

ISLAMABAD, (APP - UrduPoint / Pakistan Point News - 21st May, 2026) Another Intra-Court Appeal (ICA) has been filed before the Islamabad High Court (IHC) challenging the single bench decision of April 30, in the One Constitution Avenue case.

The appeal was filed by Khula Kamal and other residents of the apartment complex, naming the Capital Development Authority (CDA) and BNP Private Limited as respondents.

The appeal contends that the single bench had declared the cancellation of the master lease deed of One Constitution Avenue as lawful. The single bench had observed in its decision that third-party appellants would sink or swim along with the master lease deed.

The appellants maintain that they are the original purchasers of the apartments, having paid the full amount and taken possession. They argue that they have no role in any alleged default or violation committed by BNP Limited.

"The single bench's decision has caused irreparable loss to the rights of the purchasers," the appeal states. It further claims that following the decision, the CDA and administration have initiated forcible eviction measures.

The appeal prays that the single bench's decision be declared null and void for the protection of the constitutional and proprietary rights of the purchasers.
