ISLAMABAD, (APP - UrduPoint / Pakistan Point News - 21st May, 2026) The Federal Constitutional Court has issued notices to the Punjab Healthcare Commission and the surgeon involved in a case of alleged medical malpractice, seeking their formal responses regarding an appeal filed by a doctor claiming a colleague performed a botched surgery on him.
A two-member bench, headed by Chief Justice Aminuddin Khan, heard the appeal filed by Dr. Talal Khurshid. During the proceedings, Justice Ali Baqar Najafi inquired about the nature of the injuries sustained by the petitioner.
Counsel for the petitioner, Advocate Ehsan Khokhar, informed the court that Dr. Khurshid’s shoulder was severely injured in an accident, after which he underwent surgery that proved to be unsuccessful and incorrect. He stated that a medical board concluded the complications from the failed procedure could not be treated within Pakistan. Consequently, the Punjab government provided funding for Dr.

The petitioner's counsel argued that previous dismissals of the case by the Punjab Healthcare Commission and subsequent courts were based on a technicality, specifically a requirement that complaints regarding surgery must be filed within 60 days of the procedure. He contended that the case was never heard on its merits.
Advocate Khokhar explained that while the surgery in question took place in 2018, it was not until 2021 that domestic and international medical experts determined the procedure had been performed incorrectly. He asserted that Dr. Khurshid approached the Punjab Healthcare Commission immediately after this determination was made.
All relevant medical reports and documentation supporting the claim have been submitted to the court along with the appeal.
The court has adjourned the hearing until a later date.
