Hearing of One Constitution Avenue Case Adjourned due to non-svailability of bench

The hearing of applications seeking to become parties in the intra-court appeals filed by new sub-lease holders, including the owner of the Pakistan Tehreek-e-Insaaf (PTI) founder's apartment in the One Constitution Avenue project, could not take place due to the non-availability of the division bench

ISLAMABAD, (APP - UrduPoint / Pakistan Point News - 10th Jun, 2026) The hearing of applications seeking to become parties in the intra-court appeals filed by new sub-lease holders, including the owner of the Pakistan Tehreek-e-Insaaf (PTI) founder's apartment in the One Constitution Avenue project, could not take place due to the non-availability of the division bench.

The division bench comprising Justice Muhammad Azam Khan and Justice Inaam Ameen Minhas was scheduled to hear the case. However, the cause list for all cases was cancelled due to the non-availability of the division bench.

The stay order restraining authorities from evicting the apartment owners has been automatically extended until the next hearing. The sub-lease holders of the One Constitution Avenue project have obtained a stay order from the High Court against eviction.

Shahid Naseer, the new sub-lease holder of the PTI founder's apartment in Tower C of the project, along with Zainab Ahsan, daughter of Aitzaz Ahsan, had filed miscellaneous applications seeking to become parties in the case.

The applications stated that five sub-lease holders of One Constitution Avenue should be made appellants in the intra-court appeals, as they have legally obtained the apartments and filed intra-court appeals for the protection of their rights.

The court has already granted a stay to the appellants in the intra-court appeals under third-party rights and has restrained authorities from evicting the sub-lease holder apartment owners. The Capital Development Authority had cancelled BNP's lease for the construction of One Constitution Avenue, and the Chief Justice of the Islamabad High Court had declared the lease cancellation legal.
