The Islamabad High Court (IHC) did not grant immediate relief to 20 sub-lease holders and apartment owners of One Constitution Avenue during the hearing of intra-court appeals challenging the cancellation of the main lease
ISLAMABAD, (APP - UrduPoint / Pakistan Point News - 20th May, 2026) The Islamabad High Court (IHC) did not grant immediate relief to 20 sub-lease holders and apartment owners of One Constitution Avenue during the hearing of intra-court appeals challenging the cancellation of the main lease.
The court directed the CDA to take instructions and file a written response, adjourning further hearing until May 25.
A division bench comprising Justice Muhammad Azam Khan, and Justice Inam Ameen Minhas, heard the intra-court appeals filed by former Air Chief Mujahid Anwar Khan, former ICC President Ahsan Mani, former Senate Chairman, Wasim Sajjad, and others challenging the earlier decision.
The appellants challenged the decision up to paragraph 30 for the protection of third-party rights. Advocates Taimur Aslam and Ali Raza appeared on behalf of the appellants, while Kashif Ali Malik represented the Capital Development Authority (CDA).
"There is a clear IHC order regarding the cancellation of the lease," argued Kashif Ali Malik.

Justice Inaam Ameen Minhas noted that the rights of the owners were also defended in the Supreme Court. He inquired whether any notice to vacate the apartments had been given to the owners. "When the lease was legally valid, they were living there. If someone goes to live there now, that will be a separate matter," he said.
The court noted that the current case pertains to the affected owners, not BNP. The CDA counsel submitted that the CDA board would decide the matter in accordance with the law.
Advocate Taimur Aslam requested a stay order, alleging that authorities send police to break down doors.
Justice Muhammad Azam Khan remarked, "The building is standing, it is not going anywhere. We ask them what they actually want to do."
