ISLAMABAD, (APP - UrduPoint / Pakistan Point News - 12th May, 2026) The Islamabad High Court on Tuesday issued notice to the Capital Development Authority (CDA) and sought its response on an intra court appeal filed by apartment owners of One Constitution Avenue challenging certain observations made in a single bench judgment regarding lease cancellation.
A division bench comprising Justice Muhammad Azam Khan and Justice Inaam Ameen Minhas heard the appeal filed by 19 apartment owners.
The court also issued notice on a request for a stay order and adjourned further proceedings.
The apartment owners counsel Taimoor Aslam informed the court that they had no objection to the portion of the judgment regarding lease cancellation.
He said the intra court appeal had been filed against the courts observation in paragraph 37 pertaining to third party rights.
<?php /*?> <?php */?>The counsel informed the court that the building has two towers with 240 apartments. When the building was being constructed, the CDA had no objections. Overseas Pakistanis invested their savings in this project. The apartment owners have nothing to do with BNP. Diplomats and families reside in this building.
He further argued that the Supreme Courts order had directed the CDA to submit a plan of action while protecting the rights of third parties. Justice Inaam Ameen Minhas remarked that there has been a clear violation of the Supreme Courts 2019 order and questioned what consequences would follow.
The court issued notices on the appeal as well as the stay application and adjourned the hearing.
