PHC Bannu bench quashes FIR against Judges Humayun, Siddiq Dilawar

PESHAWAR, (APP - UrduPoint / Pakistan Point News - 6th May, 2026) The Bannu Bench of the Peshawar High Court on Wednesday quashed an FIR registered by the Anti-Corruption Establishment Khyber Pakhtunkhwa against judges Humayun Dilawar and Siddiq Dilawar.

A two-member bench comprising Justice Tariq Afridi and Justice Sabitullah announced the verdict after reviewing the record and reports submitted by relevant authorities, deciding the case in favor of the petitioners.

According to court proceedings, the Anti-Corruption authorities had raised objections over the transfer of several land parcels in Bannu, arguing that the property was transferred in the name of Dilawar Khan, father of the two judges, on the basis of a judicial decree dated March 30, 1980, which allegedly did not explicitly authorize ownership transfer.

However, the district administration of Bannu, through a report submitted by the Deputy Commissioner’s office, clarified that the 1980 decision was issued under Section 145 of the Criminal Procedure Code and pertained to a dispute over illegal possession, in which possession of Dilawar Khan was maintained.

The report further explained that when a watercourse or passage ceases to exist, the land is considered the property of adjacent owners. It noted that the passage in question had already ceased to exist following the construction of a dam in 1952–53, thereby making the ownership claim of Dilawar Khan and other co-sharers lawful.

A committee comprising the patwari, girdawar, tehsildar, and Assistant Commissioner Revenue also unanimously declared the registered deeds and mutations as legal. No encroachment or excess possession was identified during the demarcation process.

After examining the Deputy Commissioner’s report and available evidence, the court held that the allegations of the Anti-Corruption Establishment lacked solid grounds, and therefore, continuation of the FIR was unjustified.
