The case, unfolding in a courtroom near San Francisco, pits Musk against a company he once helped establish but now competes with in the rapidly expanding artificial intelligence sector.
At the center of the dispute is OpenAI’s widely used chatbot ChatGPT, which rivals Musk’s Grok developed by his xAI venture.
Musk’s lawsuit accuses OpenAI of abandoning its original nonprofit vision.
Court documents state that Sam Altman had persuaded Musk in 2015 to support the initiative as a nonprofit entity aimed at benefiting humanity. Musk contributed nearly $38 million before eventually parting ways with the organisation.
Since then, OpenAI has transformed into a major commercial force, attracting significant investment, including backing from Satya Nadella’s microsoft, and is now valued at hundreds of billions of Dollars with plans to go public.
The presiding judge, Yvonne Gonzalez Rogers, is expected to oversee proceedings that could conclude with a jury decision by late May on whether OpenAI violated commitments made to Musk or simply evolved its business model in response to market demands.
Musk claims he was misled about the organisation’s long-term structure, pointing to internal communications suggesting continued commitment to a nonprofit model before a for-profit arm was later introduced. He is seeking major financial damages, removal of key leadership including Altman and co-founder Greg Brockman, and a restructuring of OpenAI back to its original nonprofit form.
OpenAI, however, has rejected the allegations, arguing the dispute stems from Musk’s desire for greater control rather than concerns about its mission. The company maintains that its hybrid structure, combining nonprofit oversight with a commercial arm, was necessary to sustain the massive investment required for AI development.
The case has also revived broader questions about whether advanced AI technologies should primarily serve public interest or commercial gain, as competition intensifies in the global tech landscape.
